1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of yashvikonnect.com (the "Website") operated by Yashvi Konnect ("we", "us", "our"). By accessing or using the Website, you agree to be bound by these Terms.
These Terms govern Website use only. Engagement-specific terms are documented in separate Master Service Agreements ("MSA") signed before each client engagement. Where these Terms and an MSA conflict, the MSA controls.
If you do not agree to these Terms, do not use the Website.
2. Services
Yashvi Konnect is an eCommerce growth and development agency. The Website is informational. Services described on the Website (Semantic SEO, Conversion Rate Optimization, Performance Marketing, Speed Optimization, Web Development) are delivered under separate engagement agreements signed after qualification and scoping. Engagement minimums, payment terms, and commercial conditions are documented in the applicable MSA, not on this page.
The Free Growth Audit referenced on the Website is provided at our discretion subject to qualifying criteria stated on the audit page. We may decline audit requests for stated reasons including but not limited to: business stage, fit, capacity, or any other reason.
3. Acceptable Use
You agree to use the Website only for lawful purposes. You shall not:
- Use the Website in any way that breaches applicable Indian or international law
- Submit false, misleading, or fraudulent information through any form
- Attempt to gain unauthorized access to systems, accounts, or data
- Use automated tools (bots, scrapers) to extract content from the Website without prior written consent
- Distribute viruses, malware, or other harmful code
- Reverse-engineer, decompile, or disassemble any portion of the Website
- Use the Website content for competitive intelligence by competitor agencies
4. Intellectual Property
All content on the Website (text, graphics, logos, images, methodologies, case studies, blog posts, and software) is owned by Yashvi Konnect or licensed to us. It is protected by Indian and international copyright, trademark, and other intellectual property laws.
You are granted a limited, revocable, non-exclusive license to view and use Website content for personal, non-commercial purposes. You may share short excerpts with proper attribution. You may not republish, redistribute, or commercially use Website content without prior written permission.
"Yashvi Konnect" and the Yashvi Konnect logo are trademarks of Yashvi Konnect. Other trademarks (Shopify, WooCommerce, Google, Meta, etc.) are the property of their respective owners.
For services delivered under signed MSAs, intellectual property in deliverables (work product, custom code, audit findings) transfers to the client on full payment of the relevant invoice, unless the MSA states otherwise.
5. Confidentiality
For active client engagements, both parties enter a mutual non-disclosure obligation as documented in the MSA. Confidential information shared during scoping, audit, or engagement delivery is treated under that obligation. Public Website use is not, by itself, confidential.
6. Disclaimers
The Website and its content are provided "as is" and "as available" without warranties of any kind, express or implied.
- No guaranteed outcomes: Case studies, methodology descriptions, and blog content describe past results and general principles. They are not promises of specific outcomes for any reader business.
- Forward-looking statements: Any forward-looking statements (about market trends, platform changes, AI search) reflect our opinion at the time of publication and may become outdated.
- Third-party content: Where the Website references third-party tools, platforms, or services, we do not warrant their performance or fitness.
- Website availability: We do not warrant that the Website will be available without interruption, error-free, or secure against all attacks.
7. Limitation of Liability
To the maximum extent permitted by law:
- Yashvi Konnect shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to Website use
- Our total aggregate liability arising from or related to Website use (excluding services delivered under signed MSAs) shall not exceed INR 1,000
- Liability arising from services delivered under signed MSAs shall be governed by the limitation provisions in those agreements
Some jurisdictions do not allow exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law. Nothing in these Terms limits statutory consumer rights under the Consumer Protection Act 2019.
8. Indemnification
You agree to indemnify, defend, and hold harmless Yashvi Konnect, its directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Website, or violation of applicable law.
9. Termination
We may suspend or terminate your access to the Website at any time, without notice, for breach of these Terms or for any other reason at our discretion. Termination of Website access does not, by itself, terminate or modify any active engagement, which is governed by the applicable MSA notice provisions.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of India, including the Indian Contract Act 1872, the Information Technology Act 2000, and the Consumer Protection Act 2019 where applicable.
Any dispute arising out of or related to these Terms or Website use shall be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India. The parties consent to such jurisdiction and waive objections based on inconvenient forum.
Where statutory consumer rights apply, nothing in these Terms restricts a consumer's right to pursue remedies under the Consumer Protection Act 2019.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via the Website (banner notification). Continued use of the Website after changes take effect constitutes acceptance of the revised Terms.
12. Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect.
